HRTeamware Terms of Use
Welcome to HRTeamware. By accessing and using www.HRTeamware.com (the "Website") or the HRTeamware mobile application (the "App"), you agree to comply with and be bound by the following Terms of Use. Please read these terms carefully. If you do not agree with any part of these terms, you must not use our Website, App, or related services (collectively, the "Platform").
1. Overview
HRTeamware is an HR technology platform designed to streamline human resource processes, including employee records, recruitment, schedule and leave management, timekeeping, performance evaluations, compensation and benefits, payroll and related services.
2. Acceptance of Terms
By accessing the Website, downloading or using the App, creating an account, or otherwise using any part of the Platform, you confirm that:
You are at least 18 years old and legally authorized to enter into a binding agreement.
You agree to comply with all applicable laws and regulations in the Philippines.
3. Use of the Platform
You agree to use the Platform only for lawful and intended purposes. You must not:
-Misuse, interfere with, or disrupt the Platform’s functionality.
-Access or attempt to access data that is not intended for you.
-Introduce malware, viruses, or harmful code.
-Reproduce, duplicate, sell, or exploit any part of the Platform without our written consent.
4. User Accounts
To access certain features, you may be required to register an account via the Website or the App. You are responsible for:
-Maintaining the confidentiality of your login credentials.
-Ensuring the accuracy of the information you provide.
-All activities conducted under your account.
HRTeamware will not be liable for any loss or damage arising from unauthorized access to your account due to your failure to secure your login credentials.
5. Data Privacy
Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, store, and use your data in accordance with the Data Privacy Act of 2012 (RA 10173) of the Philippines.
Session and Location Data:
By using the Website or App, you acknowledge and agree that the Platform may obtain and store session-specific data (such as login sessions, ip addresses, device details, and activity logs) and geo-tagging information (such as your location at the time of clock-in or service use). These are collected only in connection with features and functions that have been enabled or activated by your organization or account administrators. Such data will be used exclusively to deliver and enhance the services available to you under your organization’s subscription.
6. Intellectual Property
All content on the Platform—including the system, logo, design, App, software, and related materials—is the property of HRTeamware and protected under Philippine intellectual property laws. You may not reproduce, modify, or distribute any part of the Platform without written permission.
7. Service Availability
We strive to provide continuous and secure access to the Platform. However, we do not guarantee uninterrupted service and reserve the right to modify, suspend, or discontinue any feature or functionality of the Website or App at any time, with or without notice.
8. Termination
We reserve the right to suspend or terminate your access to the Platform at any time if:
-You violate these Terms of Use.
-Your actions compromise the security or integrity of the system.
-We are required to do so by law or government directive.
9. Limitation of Liability
To the extent permitted by law, HRTeamware and its affiliates will not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, profits, or business interruption, arising from your use of the Platform.
10. Modifications
HRTeamware may update these Terms of Use from time to time. Updates will be posted on the Website and, where applicable, through the App with the updated effective date. Continued use of the Platform following such updates constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising under these Terms shall be settled in the appropriate courts of Metro Manila.
